These Terms of Service govern your use of the static website hosting service provided by DS Webhosting Services (ABN 42 988 054 565), a business based in Victoria, Australia ("we", "us", "our"). By creating an account and using our service, you agree to these terms.
If you do not agree to these terms, do not use the service.
We provide static website hosting — the ability to upload HTML, CSS, JavaScript and associated asset files and have them served from an Australian-based server via a subdomain under hosting.dswebhosting.net.au, with the option to use your own domain name.
The service is intended for static websites only. It is not suitable for and does not support:
You must provide accurate and complete information when creating your account, including your full name, contact details and address. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
You must be at least 18 years of age to create an account.
You may use the service to host any lawful static website. You must not use the service to host or distribute content that:
We reserve the right to remove content and suspend or terminate accounts that violate these conditions without notice.
The service is provided on a monthly subscription basis at $5.00 AUD per month. Payment is processed through PayPal. Your subscription renews automatically each month until cancelled.
If payment fails, we will attempt to notify you by email. Your site may be suspended if payment remains outstanding after reasonable notice. Prices are inclusive of GST where applicable.
You may cancel your subscription at any time through your PayPal account. Your site will remain active until the end of the current billing period. We do not provide refunds for partial billing periods.
Upon cancellation, your hosted website files will be deleted. Your account information will be retained for two years in accordance with our obligations under the Telecommunications (Interception and Access) Act 1979 (Cth). See our Privacy Policy for details.
We aim to provide a reliable service but do not guarantee 100% uptime. Scheduled maintenance will be communicated by email where possible. We are not liable for any loss arising from service interruptions.
Each account includes 250MB of storage. Files must not exceed 10MB individually. We reserve the right to suspend accounts that significantly exceed these limits or that consume excessive server resources.
You retain ownership of all content you upload. By uploading content to our service, you grant us a limited licence to store and serve that content for the purpose of providing the service.
We do not monitor the content of hosted websites but reserve the right to remove content that we become aware is in breach of these terms or applicable law.
To the maximum extent permitted by Australian law, DS Webhosting Services is not liable for any indirect, incidental, special or consequential loss arising from your use of the service, including loss of data, loss of revenue or business interruption.
Our total liability to you for any claim arising from these terms or the service is limited to the amount you paid us in the three months preceding the claim.
Nothing in these terms excludes any guarantee, right or remedy that cannot be excluded under the Australian Consumer Law.
These terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
We may update these terms from time to time. We will notify active customers of material changes by email at least 14 days before the changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms.
